Disturbing news over on the Megalithic Portal where Pete G has asked for all his photographs to be withdrawn because of un-authorised use... http://www.megalithic.info/modules.php?op=modload&name=Forum&file=viewtopic&topic=2119&forum=1

I know that Pete is a professional photographer and therefore depends on his shots to provide him with a living but how about the rest of us?
Do we trawl through every conceivable publication to find if one of our pics has been used without permission?

I know that there is a copyright warning shown on the picture pages but would it be feasible for ALL the contributions here to be "Watermarked" so that publishers would have to go to the originator to get a usable copy?

It would be a great loss if this, and other, superb archives are gradually whittled away because of this problem.

Jim.

On sites like Flickr you can display a little icon showing how you want your image to be used, you can choose that people can use it freely, can derive things from it freely, that they have to acknowledge you or not, that they can't use it at all unless they pay up etc etc - lots of different combinations. I have to admit to using people's (Flickr) photos in artwork I've been doing - but it's just personal stuff, I'm not showing it or getting money for it. And if you alter it substantially you're usually ok. Straightforward reproduction on someone's website though, that's a different matter I guess (most photos on the web wouldn't be of a high enough resolution to actually print out and sell?). I think on Photoshop there's a watermark adding thingy, and there's bound to be some freeware somewhere that'll do it too? Anyway I think I'm saying that I think it's down to the individual to put the watermark on, I think it's a shame to have every photo marked if the contributer isn't really that bothered?

An associated question please.

Am I legally entitled to paint images that are on the web (as accurately as possible) and then sell them?

(Not ones from here or of megalithic subjects).

Yes, I often find my pictures used by other people who have nicked them off my website and think it's OK to use them with asking me or giving me a picture credit or a link. Bastard thieves!

The worst ones are the ones that point their code at your website, so you end up hosting the damned picture for them too. This website is currently doing that: http://www.myspace.com/tencc
See the first photo? That's mine. And if you look at the properties, I'm frigging hosting it for them! I have emailed them to give 'em a chance to 1.apologise and grovel, and 2. remove it themselves, but so far, no cigar. So tonight I'll rename the pic and break the link.

not anymore.
My photo agency sold out to getty images and expected me to take a drop in sales in 40% with new T&C's which were frankly unacceptable.
I cannot be bothered to sign up with another agency and spend all that soul destroying time uploading and tagging images.

It's very naughty when people do it, but I don't have that many pix that are shit-hot, so it doesn't often happen to me - that I'm aware of! I've only ever flogged a few pix (tho I guess that's not bad as I don't try to sell 'em!) Must be really bad when you're relying on sales to earn a living.

It only bothers me if it's for commercial use. But so far it hasn't bothered me enough to do anything other than not (generally) post high enough res to print decently. For anything else, I'd ideally like a credit, but....

I can't imagine stopping posting them online anyway, as the web's the only place anyone sees my pix & I don't have the time to set up my own site - let alone do it in a way that would protect the images as much/little as you can.
