There are various levels of copyright methinks. Ultimately you should ask permission of the landholder, be it National Trust or Historic Scotland or whoever, just as strictly speaking you should do with people and their homes. This also usually applies to those working on an excavation. All a matter of courtesy unless someone is being really silly.

More than 'just courtesy' though if you're making money from the photograph? Would you have to pay a fee then?

Or perhaps you might not like the context the photograph was used in? Say a photo of a church with a pagan ceremony? (Only wondering like)
