If you took the picture from the highway you do not need to seek permission.

However, it's just courtersy to ask.

So on someone else's land you need their permission, but from a highway you don't?

There are various levels of copyright methinks. Ultimately you should ask permission of the landholder, be it National Trust or Historic Scotland or whoever, just as strictly speaking you should do with people and their homes. This also usually applies to those working on an excavation. All a matter of courtesy unless someone is being really silly.
