I've only got the loosest grasp of the situation but it seems Nic Turner's insistence on touring America under the Hawkwind imprint, and so scuppering Dave Brock's own tour, has made Dave Brock ill???

Sounds like adults acting like toddlers to me. Here's Turner's take on the situation.

The internet has warped my brain. I bet he wrote this all perfectly calm but it reads like he's screaming it at the top of his lungs.

I WAS A FOUNDER MEMBER OF THE BAND ‘’GROUP X’,’ HAWKWIND ZOO’ AND ‘HAWKWIND’.[IN FACT THE BAND’S NAME ‘HAWKWIND’ WAS COINED AS A NAME FOR ME, BY THE LATE JOHN HARRISON, THE BAND’S BASS-PLAYER, NO LESS], TO DESCRIBE CERTAIN UNSAVOURY HABITS OF MINE, OF BREAKING WIND AND SPITTING, A HABIT I HAVE NOW GROWN OUT OF!!??1. THE BAND ULTIMATELY WAS SIGNED BOTH JOINTLY AND SEVERALLY, TO UNITED ARTISTS RECORDS, AS ‘HAWKWIND’, THE MEMBERS COMPRISING MICK SLATTERY, TERRY OLLIS, JOHN HARRISON, DIKMIK DAVIS, DAVE BROCK AND MYSELF.

AFTER I HAD LEFT THE BAND, ME BEING THE LAST OF THE ORIGINAL MEMBERS TO BE MANIPULATED OUT OF THE BAND BY DAVE, IT WAS SUGGESTED TO ME BY DOUG SMITH, THAT ALL THE ORIGINAL MEMBERS OF THE BAND MIGHT FORM THEIR OWN BANDS E.G. NIK TURNER’S HAWKWIND, TERRY OLLIS’S HAWKWIND, DIKMIK DAVIS’S HAWKWIND, MICK SLATTERY’S HAWKWIND, JOHN HARRISON’S HAWKWIND AND DAVE BROCK’S HAWKWIND. NO-ONE DID SO AT THE TIME, BUT IN 1994, WHILST TOURING USA I CALLED MY BAND NIK TURNER’S HAWKWIND, AND FOUND MYSELF THREATENED WITH INJUNCTION, BY THE BAND’S AGENT, AND THE THEN AGAIN MANAGER DOUG SMITH. AT THE TIME I WAS NOT AWARE THAT THE NAME HAD BEEN TRADE-MARKED IN BRITAIN, AND IN FACT HAD NOT BEEN TRADE-MARKED IN USA, SO THESE THREATS WERE COMPLETELY SPURIOUS IN THE USA.

WHEN DAVE DECIDED TO TRADE-MARK THE NAME, ‘HAWKWIND’, HE WAS ADVISED BY DOUG SMITH, HIS MANAGER, TO GET THE PERMISSION OF ALL THE MUSICIANS ON THE ORIGINAL UNITED ARTISTS AGREEMENT, WHO HAD JOINTLY AND SEVERALLY SIGNED THE AGREEMENT AS ‘HAWKWIND’. THIS HE DID NOT DO, AND THE TRADE MARK WAS REGISTERED IN DAVE’S NAME, WITHOUT THE PERMISSION OF, OR REFERENCE TO, THE OTHER PARTIES. THAT TRADE-MARK THEN STOOD, AND DAVE INJUNCTED ME FOR CALLING MY BAND EX-HAWKWIND, [ALL MEMBERS BEING EX-MEMBERS OF HAWKWIND], CLAIMING I WAS TRYING TO PASS MY BAND OFF AS HAWKWIND, WHICH OF COURSE, I WAS NOT. UNFORTUNATELY I COULD NOT AFFORD TO FIGHT THE CASE, WAS ILLY-ADVISED BY MY SOLICITOR, DESERTED BY MY MANAGER , AND ENDED UP SETTLING THE MATTER OUT OF COURT, TO MY COST.

IN THE CURRENT SITUATION, IN THE U.S.,THE NAME HAWKWIND WAS TRADE-MARKED IN MY NAME, IN ORDER THAT I MIGHT ATTEMPT TO REDRESS THE SITUATION AND PUT THE RECORD STRAIGHT, BY TRANSFERRING THE TRADE-MARK TO THE NAMES OF THE ORIGINAL SIGNATORIES OF THE ORIGINAL UNITED ARTISTS CONTRACT, TERRY OLLIS, MICK SLATTERY, DIKMIK DAVIS, JOHN HARRISON, [DECEASED], AND RATHER THAN DAVE BROCK, DAVE BROCK’S SON, PASCO BROCK.

HAWKWIND AT THE OUTSET WAS ALWAYS A ‘PEOPLES’ BAND, WITH A COMMUNAL SPIRIT WITH ALTERNATIVE IDEA, AND IDEALS, IN AN ALTERNATIVE CUTURE .THOSE WHO WISH TO MAY JUDGE ME AS THEY SEE FIT, BUT THIS WAS DONE OUT OF A SPIRIT OF FAIRNESS, AND INCLUSIVENESS, AND I HOPE YOU ALL UNDERSTAND AND AGREE THAT IT A WAY FORWARD. dunno if you ever read this but there's a fair bit about it from Nik's point of view in it.

Yeah, I saw this one on Faceache and had my say, there. It's A) a very cheap form of marketing to raise the profile and advertise a US tour (or two). It's B) a finally showdown of two cantankerous old duffers - or C) A fuckin' soap opera.

I don't know the rights and wrongs of this, but after all these years, someone needs to bang their heads together once and for all. It's not like it's of any major importance anymore - Hawkwind's day was done decades ago.

I thought they'd got it right for both bands and fans when Nik Turner and co settled on "Space Ritual" as a touring/recording name. Made perfect sense, you knew what you were getting and it seemed that all parties were happy with that, job done. Just a shame they're dragging this out again.

Now there are rumours that Hawkwind have been refused entry to the USA and are blaming Nik Turner's campaign. Oh dear...

Nik is a great performer, an ok guy who should have been concentrating on his own career rather than Hawkwind's, but he's like a sad old queen who does bitter so well, and unlike Dave, he's aired his dirty washing all over the internet.

His argument may seem plausible by someone who is taken in by all this trippy-hippy nonsense about 'redressing the balance man' with the added 'I'll see you at a festival soon', but it's shot full of holes. Nik used to have the van, and was going to be the bands roadie until he got the sax out and started jamming with them. The band evolved out of Brock's 'Famous Cure'and the origin of the bands name is debateable, some ex members, and it's far too many for them all to claim a bit part of the name, state it was something to do with Nik's habits, while others refer to Moorcock's 'Hawkmoon' as the source. Whatever it is, and it's a matter of varied opinion, Nik could not claim in a court of law that he has legal written proof that he is the source of the name, no more than he could lay legal claim to the often argued point that he is the spirit of Hawkwind.

He was sacked from Hawkwind in '76, not because he was manipulated out by Brock/Calvert, that's just his slant on what occured, but because the band needed a new direction in the changing musical climate and because he was a liability by the nature of his playing which had become so bad. Dave Brock has been at Hawkwind's helm from the beginning to date, by rights no one else should be able to claim they are such a major player in the scheme of things and are, therefore, entitled to legally use the brand name, Nik doesn't even need to, he just times his gripe, and at his age to, in order to maximise damage against a band that are still hugely popular and a commercially marketable commodity.

I wonder how many years it is since Turner and Brock sat down face to face without bloody lawyers around and tooing and froing, taking their cuts.

I almost bought tix for Hawkwindx thinking it was the real "Hawkwind", Guilford Festival. The poster had symbols and letters all over it and a tiny x mixed in. It looked like a "Hawkwind" poster. It was a big chunk of money, for someone on the wages I was on. Eventually, I couldn't afford it, but imagine how gutted I would be, if I had gone. Nicks been in the band 7 years, it's Dave's lifetime of work over 50 years. Nicks version of the band is piss poor. My mates met Nick, he tried to get one of them do security for free at another festival. My mate asked Nick if he was playing for free, Nick said yes, along with some I'm a do good type story. My mate found out later, he was playing for over £700 possibly nearer £800 , this was 15/20 years ago. Dave Brock's a nice bloke.
