as far as I know it has already run at a loss for 2 years, same as other B&B's in the area because of the weak $ and the lack of US tourists since 9/11.
So Proving they deliberately run the business into the ground is going to be hard.

It's not the B&B bit that requires a change of use authorisation, it's the pub side of things.
