"Unfortunately its up to the judges discretion to decide if the case was taken in the public interest or by a time waster using public money for spurious actions, delaying large projects"
.... and there's the Heritage Catch 22.
If the judge or the executive or the legislature has decided that public interest always lies in development in preference to conservation - which they pretty much have in Ireland - then ANY opponent must therefore be a timewaster and ALL opposing actions are spurious.
Anyone now fancy risking bringing an action about anything at all???
