Unfortunately its up to the judges discretion to decide if the case was taken in the public interest or by a time waster using public money for spurious actions, delaying large projects. Vincent obviously wasn't a time waster, if anything the government has wasted time, money and heritage here by using the most contentious route, thereby guaranteeing legal action, long delays, wasted money and a permanent scar on the Tara-Skryne valley. To add to this unfortunate state of affairs there was very little local objection to the motorway, the judge made a lot of hay with this.
Its not Irish logic, its bloody mindedness. The offical emmissions policy for example, revealed last budget, is not to pump money into clean initiatives, its to hoard the cash to pay the inevitable fines for breach of regulations. The heritage and enviornment policy in Ireland makes George B's 'Clear Skies' initiative look like a useful tool for preserving the planet.
On the other hand the case can be taken to Europe, Tara is also part of European heritage.
