The question is Alcan, how far is 'far above?' I would take that as meaning passenger plane height, whereas a drone of the type we are discussing operates far lower.

Yep, the height a drone flies at would generally be considered to be part of the ownership of the surface. There have been court cases about things like advertising hoardings over land.
